Tendering notice, then retracting it
Many employees are not aware that once they have given notice of resignation there is no obligation on the employer to agree to their request to retract it. Employees should therefore be certain before they tender their resignation. However it isn’t always clear when an employee has given notice of resignation as sometimes the words that they use in their resignation letter can be open to interpretation. This was seen in the recent case of Levy v East Kent Hospitals University Foundation Trust.
